These are the terms on which Hermizon sells to you through this website. Placing an order means you accept them. Please read them before you do.
1. Who you are dealing with
Hermizon, Shop# 32 (Level-5), Gulshan Pink City, Gulshan 2, Dhaka 1209, Bangladesh. [to confirm: registered trade name, trade licence number and TIN/BIN, if these should appear]
2. Using this site
You must be 18 or older to place an order, or have a parent or guardian do it for you. You agree not to use the site to defraud us, to interfere with how it runs, or to copy its contents for commercial use.
3. Your account
You are responsible for keeping your password to yourself and for what happens under your account. Tell us at once if you think someone else has access to it. We may suspend an account we believe is being used fraudulently.
4. Products, colour and handmade variation
We describe and photograph every pair as accurately as we can. Screens differ, and every pair is finished by hand, so the colour, grain, texture and the exact placement of embellishment will vary slightly from the photograph and from pair to pair. That variation is inherent to the product and is not a defect.
Stock shown on the site is our best current figure. Occasionally a pair sells out between your order and our packing it — if that happens we contact you and either substitute with your agreement or cancel that line.
5. Prices and payment
All prices are in Bangladeshi Taka (BDT) and are the price payable at the door, plus the delivery charge shown at checkout. All prices include VAT; nothing else is added at checkout.
Payment is cash on delivery. [to confirm: list any other methods once gateways are live] We do not ask for card or wallet details on this site, and you should treat any request that appears to come from us asking for them as fraudulent.
If a price is listed wrongly through an obvious error, we are not obliged to sell at that price. We will tell you and let you confirm or cancel.
6. Your order, and when the contract is made
Your order is an offer to buy. Our confirmation email acknowledges it but does not accept it. The contract is made when we dispatch the parcel. Until then we may decline an order — for example if we cannot verify the delivery address, if stock has run out, or if the order looks fraudulent.
7. Cancelling
You may cancel free of charge at any time before dispatch — call, WhatsApp or email us. After dispatch, refusing the parcel at the door cancels the sale and you pay nothing, but if it happens repeatedly we may stop offering cash on delivery to that number.
8. Delivery
Charges, areas and timings are on the Shipping & Delivery page. Delivery estimates are estimates — couriers are affected by weather, hartal and peak season, and we cannot guarantee a date.
9. Exchanges, returns and warranty
Set out in full on the Exchange & Returns Policy and the Warranty page. Both form part of these terms.
10. Reviews and anything else you post
Reviews must be your own honest experience of a product you bought. We remove anything abusive, defamatory, off-topic, commercial, or written to promote or damage a business. We do not edit the substance of a review to make it more favourable, and we do not delete a review because it is critical. Posting a review gives us permission to publish it on this site.
11. Our content
The Hermizon name, logo, product photography, designs and site text belong to us. You may not reproduce them commercially without our written permission.
12. What we are responsible for
We are responsible for supplying the products you ordered, to the standard set out here and in the warranty. We are not responsible for losses that were not foreseeable, or for loss of profit or business opportunity. Nothing in these terms limits any liability that cannot be limited under Bangladeshi law, including for death or personal injury caused by our negligence.
13. Events outside our control
We are not liable for delay or failure caused by something outside our reasonable control — flood, cyclone, strike, hartal, power failure, epidemic or courier collapse. If it happens we tell you and, if the delay is long, you may cancel.
14. Privacy
How we handle your personal information is set out in the Privacy Policy.
15. Changes to these terms
We may change these terms. The version that applies to your order is the one published when you placed it, and the date at the top of this page tells you when it last changed.
16. Governing law
These terms are governed by the laws of Bangladesh, and the courts of Bangladesh have jurisdiction over any dispute. [to confirm: whether to name Dhaka specifically]
